Want to get to an open prison as soon as possible?

All prisoners are categorised at the start of their sentence and their categorisation is reviewed periodically during the course of that sentence. Male prisoners are categorised as Category A, B, C or D, depending on the length of their sentence and the nature of their offence.

No matter whether you start out at Cat A or Cat C, all prisoners are entitled to reviews of their categorisation and most prisoners want to get to Cat D as soon as possible!

The Governor is in charge of making decisions as to when a prisoner may be granted a down grade in categorisation (except in the case of IPPs, Lifers and Cat As) and they are very often assisted by re-cat representations from a prison lawyer.

Cat B prisoners will need to be granted Cat C status before they can be considered for Cat D and once you are Cat C you will obviously want to move to Cat D and get to open conditions as soon as possible. Our prison lawyers are here to help you gain Cat D status as soon as possible!

We can help prisoners and their families, by providing realistic advice and by submitting representations to the Governor to help persuade them that a downgrade in security category is appropriate for our client.

Unfortunately prisoners are no longer entitled to legal aid for re-categorisation reviews, but at CM Solicitors we pride ourselves on offering reasonable fixed fees for re-categorisation advice and representation. For a low, one off fixed fee, we will deal with your review and make every effort to ensure that you receive a downgrade in categorisation.

Recategorisation Appeal

Been refused re-cat for no reason?

Sadly on many occasions, prisoners are refused downgrades in security category simply because the Governor did not have as much information as he/she could have, or because of “security reasons” which are in fact unfounded.

Prisoners are entitled to appeal against a Governor’s decision to refuse a downgrade in security category and we are here to help you do that!

Appeals must be submitted within 28 days of receipt of the initial decision and so it is important to act fast. You or a member of your family can telephone us for initial advice, if we feel the refusal is challengeable then we will submit representations to the Governor to appeal against the refusal decision.
