Last June CM Solicitors secured a large compensation aware for one of their clients who suffers from Cauda Equina Syndrome also known as CES.
Emma had a history of back problems and was due to have an operation on the base of her spine. She attended her GP in complaining of a loss of feeling in her pelvic area. This is a recognised “red flag” symptom and a possible sign that the sufferer is experiencing the onset of cauda equina syndrome caused by the compression of the nerves in the lower portion of the spinal canal.
If not diagnosed and acted upon quickly cauda equina syndrome can lead to bowel and bladder incontinence and a permanent loss of sensation in the pelvic area. If the “red flag” signs are not responded to in the first 48 hours after reporting then the patient can be incapacitated for life.
Despite having a full knowledge of her history of spinal problems, Emma’s GP failed to spot these signs and diagnosed a bladder infection giving her antibiotics instead. Emma had been told by her specialist to inform the hospital if she had any change in her medication. So merely as a matter of updating them she called the hospital and told them.
They asked her why she had been put on antibiotics at which point she described her symptoms. The nurse broke off from the call and after 1 minute advised her to come in to hospital immediately. Unfortunately for Emma by then it was too late . . .
