CM Solicitors complex personal injury department has achieved another very large settlement for another valued client.
Mr H came to us in the Winter of 2011 shortly after 5th November. Every year he had purchased one or two high value, quality fireworks from his local reputable dealer in order to watch them with his family in the comfort of his own back garden.
As a result of what could quite easily be described as a more than a million to one chance, a manufacturing defect in one part of the firework, caused one of the “launch tubes” to become dislodged. The tube had yet to fire off it’s charge but when it did, it was pointing directly at our client.
Seconds later the charge was launched and exploded millimetres from Mr H’s left eye despite the fact that he and his family were stood more than the recommended 25 metres away from where the firework had been securely fixed in place.
Mr H was rushed to his local A & E department but unfortunately the sight in his left eye could not be saved.
Michael Shaw was instructed by Mr H shortly after the incident and our letter to the Defendant’s went out on 29th November 2011. The defendant’s did not admit liability straight away. The letter was sent to the importers of the firework who under the Sale of Goods Act are liable (as if they were the manufacturer) for any goods they import which are manufactured outside the EU.
Because MR H is a skilled technician in an electronics related field he was unable to continue working in this capacity as his field of vision has become severely affected. Mr H agreed to a settlement figure at the beginning of September 2014.
