The rules and regulations concerning the use of tachographs are complex. Falling foul of these regulations may result in the driver and the company employing the driver being summonsed to Court.
If convicted, then you would be reported to the Traffic Commissioner and your Operators licence could well be affected. Vehicles may be removed from the licence or be suspended for a period.
Tachographs should be properly checked and analysed and the reports you receive should be clear.
In any event, no matter how careful a driver is, simply by being stuck in congested traffic, the driver may be unable to make a stop.
We are able to advise as to possible defences and mitigation in relation to all offences concerning ‘O’ licence holders and drivers.
