If convicted, then you would be reported to the Traffic Commissioner and your Operators licence could well be affected. Vehicles may be removed from the licence or be suspended for a period.

Tachographs should be properly checked and analysed and the reports you receive should be clear.

In any event, no matter how careful a driver is, simply by being stuck in congested traffic, the driver may be unable to make a stop.
