Recent legislation has now made it possible for someone to be charged with the offence of causing death by careless driving. Section 20 of the Road Traffic Act 2006 introduced this new offence and took effect in 2008.

The penalties for causing death by careless driving are 3 to 11 penalty points or disqualification. Community based penalties can also be imposed. The maximum prison sentence is 5 years. Fines can be imposed up to £5000.
