Solicitors for Professionals

CM Solicitors regularly act for fellow professionals in disciplinary procedures and Criminal matters. We have previously acted for Accountants, Sportsmen and woman, Solicitors, Barristers, Teachers, Doctors and other medical professionals in disciplinary matters

We are able to offer our services to medical professionals who appear at the General Medical Council (GMC) whether you are covered by insurance or not. In the unfortunate circumstance, you find that you are to appear in front of the GMC without being covered by insurance, contact us immediately. We are able to take instructions from you in such matters for highly competitive rates which will include representation from experienced Barristers.

Our GMC defence lawyers provide expert representation throughout England and Wales to doctors who are not members of a medical defence organisation or who may have been refused representation by their union, for example if the allegation relates to a matter which is not specific to their professional role.

In a recent High Court decision in the case of R v Governors of X School (regarding a teacher who was accused of kissing a pupil) and the Court of Appeal decision in Kulkarni v Milton Keynes Hospital NHS Foundation Trust (regarding a doctor who was accused of sexually assaulting a patient) the courts decided that, in certain circumstances, an employee is entitled to be accompanied to a disciplinary hearing by their lawyer. The general position before these decisions was that employees had no right to legal representation at internal disciplinary hearings.

The issue of potentially broad application is that the Court of Appeal chose, even though it was not necessary for dealing with the case itself, to consider the issues of a right to legal representation and the right to a fair hearing under Article 6 of the European Convention on Human Rights (ECHR).

Criminal Law in other jurisdictions

We regularly accept instructions from clients who have Criminal issues abroad. We understand how distressing Criminal court proceedings can be for the individual and their families, especially when they are proceeding in a foreign country. We have vast amounts of experience in these matters where we can help you understand the legal system of the foreign country in which proceedings are taking place against you.

We have experience in dealing with cases in The Netherlands, France, Slovakia, Poland, Spain and other European countries.Mr Richardson’s most recent case involved a Polish national who resides in the UK. HMRC contacted our client to arrange an interview in the UK with HMRC officers and the French authorities in relation to Tax evasion in France.

Our client was represented by Ben Richardson in interview at our offices. The client informed us that having someone present at the interview gave him the confidence to answer questions in the presence of the French authorities and HMRC officers.
